By accessing or using all.gift ("the Platform"), operated by First Class Services LLC ("the Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.
all.gift is a digital gift card issuance platform that enables businesses ("Merchants") to create, sell, and manage branded digital gift cards. Consumers ("Customers") may purchase gift cards through Merchant storefronts hosted on the Platform.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use this Platform. By registering as a Merchant, you represent that you are authorized to act on behalf of the business you register.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account.
The Platform charges transaction fees on gift card sales as described in the Merchant Agreement. All payments are processed through Stripe, a third-party payment processor. By using the Platform, you agree to Stripe's terms of service.
You agree not to use the Platform for any unlawful purpose, to facilitate fraud, money laundering, or any activity that violates applicable law. We reserve the right to suspend or terminate accounts engaged in prohibited activities.
The Platform, its design, code, and content are the property of First Class Services LLC. Merchants retain ownership of their business names, logos, and branding uploaded to the Platform.
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or business opportunities.
You agree to indemnify and hold harmless First Class Services LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Platform or violation of these Terms.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Platform constitutes acceptance of the modified Terms.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Collin County, Texas.
